SPRINGS UNIFORM PRIVACY POLICY

Spring Window Fashions LLC and its subsidiaries and affiliates (sometimes referred to as “Springs”, “we,” “us,” or “our”) provides this Privacy Policy to you in order to inform you about our privacy practices when you visit our website, www.baliblinds.com, and/or the other websites or mobile applications (“App”) on which this Privacy Policy appears (collectively, the “Site(s)”) and to help you makes informed decisions when using our Website or otherwise interacting with us (collectively, the “Service(s)”).

Springs is committed to fair information practices. Please review this Privacy Policy carefully to understand our policies and practices regarding your information and how we will handle it. If a separate or different privacy policy applies to a specific application, website or service that Springs operates, we will indicate that by providing that separate specific privacy policy on that application, website, or with that service (the “Specific Privacy Policy”). With respect to the other application, website or service, those Specific Privacy Policies may apply, rather than his Privacy Policy, and to the extent there is a conflict between the terms of this Privacy Policy and Specific Privacy Policy, the terms of the Specific Privacy Policy shall apply to your use of that other applications, website, or service.

If you do not agree with our policies and practices, your choice is not to use our Site. This Privacy Policy may change from time to time (see Changes to Privacy Policy). Your continued use of this Site after we make changes is deemed to be acceptance of those changes, so please check the Privacy Policy periodically for updates.

The sources of our information primarily include our customers, visitors to our website, and business partners such as businesses with whom we co-market, co-promote, or distribute our products. We also may obtain information from third parties such as data aggregators or compilers – for instance, to help us learn more about our customers, and about those that might be interested in our products. If you apply for employment with us through this Site, we collect the following personal information: your name, address, email address, and phone number, and we may additionally collect from you information relating to your education and employment history as part of your employment application. Not all requested information is required, however, and we specifically indicate what information is required in order to submit your employment application.

We also may use your Information in any other way we may describe when you provide the information or for any other purpose with your consent.

4. PARTIES TO WHOM WE DISCLOSE YOUR INFORMATION

We may disclose Information that we collect or you provide as described in this Privacy Policy:

  • to contractors, service providers, and other third parties we use to support our business or provide functions on our behalf.
  • to advertisers and partners to share the Information, including personally identifiable information and audience segments, to help provide more tailored targeted marketing, advertising and communications.
  • to companies we co-market or co-promote our goods and services with, which may include distributors, retailers, or online marketplaces and websites.
  • to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Springs assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Springs about our Site users is among the assets transferred, including in the course of any due diligence performed in anticipation of such a transaction.

  • to prevent, detect, investigate, or remediate a security or other legal concern, including fraud.

5. AGGREGATED AND DE-IDENTIFIED INFORMATION

We may combine any Information we collect from or receive about you for purposes we’ve described. We may aggregate or deidentify your Information and may use, share, rent or sell aggregated or deidentified information for any purpose, and such information is not subject to this Privacy Policy.

Aggregated or de-identified information is not considered personal information, so long as it does not identify a user personally. We may use and disclose this aggregated and de-identified information with our affiliates, agents, business partners, and/or other third parties without restriction in any manner not prohibited by law.

6. HOW WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES

We use cookies, other tracking technologies, and unique advertising identifiers to collect information about your activity, browser, and device, and more specifically as described below:

Cookies – We use cookies to make interactions with our Site easy and meaningful. When you visit our Site, our servers may send a cookie to your computer. We may use cookies that are session-based or persistent. Session cookies exist only during one session. They disappear from your computer when you close your browser software or turn off your computer. Persistent cookies remain on your computer after you close your browser or turn off your computer. We use cookies that enable you to navigate our Site and use its features, such as accessing secure areas of our Site. Because required cookies are essential to operate our Site, there is no option to opt out of these cookies. We use cookies to provide features and Services such as:

  • Remembering your preferences and allowing you to enter your information less frequently;
  • Presenting information that is targeted to your interests, which may include our content presented on another website;
  • Analyzing how users engage with our content or use our Site;
  • Measuring the effectiveness of our Sites, Services, content, and advertising; and
  • Providing other services and features that are only available through the use of cookies.

We also work with third party advertising and data platforms that help us to use cookies to optimize our advertising – such as to locate potential customers online, to retarget to existing or prospective customers (such as consumers that have visited our website or shown interest in our products), to measure the effectiveness of online advertising campaigns, and to analyze who has viewed or clicked on our ads.

The Options/Settings section of most internet browsers will tell you how to manage cookies and other technologies that may be transferred to your device, including how to disable such technologies. You often can disable cookies through your browser settings, but please note that disabling cookies may impact some of our Site features and prevent the Site from operating properly.

Web Beacons – When you visit our Site, we may collect your IP address for certain purposes such as, for example, to monitor the regions from which you navigate our Site. We may also use web beacons alone or in conjunction with cookies to compile information about your usage of our Service and interaction with emails from us. Web beacons are clear electronic images that can recognize certain types of information on your computer, such as cookies, when you viewed a particular site tied to the web beacon. We may use web beacons to operate and improve our Site or Services.

7. HOW WE USE GOOGLE ANALYTICS

We work with service providers (including Google Analytics) who conduct analytics to help us track and understand how visitors use our Site. Google Analytics is a web analytics service provided by Google that uses cookies to help us analyze how users use our Sites. The information generated by the cookies about your use of the services will be transmitted to and stored by Google on servers in the United States. If you access our Site through different devices, Google may associate your devices with one another. Google has developed the Google Analytics opt-out browser add-on for the Google Analytics JavaScript (ga.js, analytics.js, dc.js). 8. STORAGE OF INFORMATION IN THE UNITED STATES

If you are accessing our Site from outside of the United States, your connection likely will be through and to servers located in the United States and all Information you provide will likely be processed and maintained in our web servers and internal systems located within the United States. (We generally store the Information used in our Services in the United States.) Thus, you should be aware that in accessing this Site or otherwise communicating with us, the Information we collect or receive from you may be subject to laws with lesser or different privacy standards than those in your own country (such as if you are in a country located in the European Union).

9. ADDITIONAL PRIVACY RIGHTS YOU MAY HAVE IN CERTAIN STATES

Depending on where you live, you may have certain rights with respect to your information. For example, under the laws (as they become effective on various dates) of several states (“Applicable States”), you may be able to ask us to:

  • confirm that we are processing your information
  • provide access to certain information we hold about you, in some cases in a portable format, if technically feasible
  • update or correct your information
  • delete certain information
  • restrict the use of your information
  • suppress the “sale” or “share” of your information, or (similarly) suppress the use of your information for targeted advertising
  • provide general information about our processing activities
  • withdraw your consent to our use of your information for certain processing purposes, where the processing purpose was based on your consent

We do not use your information to make decisions that produce legal or similar effects based solely on the automated processing of your information.

We will respond within the time period prescribed by applicable law. Please note that many of the above rights are subject to exceptions and limitations.

We likewise may grant certain of these rights to any consumers: for instance, any consumer may opt out of our email marketing, or access the interest-based advertising opt-out methods provided by us or provided through industry websites.

Accessing the Personal Information We Have About You

In Applicable States you may have a right to “access” or “know” about the specific information we hold about you, such as to deliver our Services.  If you are a resident of such a state and would like to request access of your personal information, you may do so by contacting us at privacy@springswf.com or you may visit our “Data Access Request” page.

For security purposes (and as required under laws of the Applicable States), we will verify your identity – in part by requesting certain information from you — when you request to exercise your privacy rights.  For instance, if you request categories or specific pieces of personal information we have received about you, you may need to confirm your possession of an identifier (such as an email address) or to provide a piece of identification that confirms you are the person you claim to be.

Authorized Agents

If you or your authorized agent would like to opt out of Springs’ use of your Information in ways considered to be a sale, share, or targeted advertising, you may do so as outlined on the following page: Data Access Request. If you are opting out through an agent, the agent should provide us with their written authorization to act on your behalf, which may be sent to us at privacy@springswf.com along with opt-out instructions.

Sensitive Data

Certain U.S. states’ laws define a category of personal information as “sensitive personal information” or “sensitive personal data,” and assign special rights to consumers with respect to that information, such as the right to opt “in” or to opt “out” of its collection and use, for purposes other than uses approved by statute (which include, for instance, legal compliance).

Those states have varied categories they deem as “sensitive,” which may include  government identifiers (e.g., social security, driver’s license, or passport number); consumer financial and log-in information and passwords, precise geolocation information, a consumer’s race or ethnicity, religion or sexual orientation, or union membership; contents of consumer third party communications, and consumer genetic data.

We do not use sensitive personal information for purposes of marketing or analytics, or for other purposes that would require us to obtain consent. For purposes of California law, we only use such information for those purposes set forth in the CPRA regulations at section 7027(m).

In some cases, you may have the right to appeal a decision made relating to your rights. Please contact us at privacy@springswf.com if you would like to inquire about an appeal.

Do Not Sell: First, consumers in Applicable States may opt out of the “sale” of their personal information. (This is required in some states, but we endeavor to extend this right to all consumers.) Those laws may broadly define “sale” in a way that may include allowing third parties, such as advertisers, advertising networks, to receive certain information such as cookies, IP address, device identifiers or other hashed identifiers, interests, browsing behavior and/or other activity to add to a profile about your device, browser, or you.

Do Not Share/Do Not Target: Consumers also may opt out of “targeted” advertising, which is sometimes referred to as “interest based” or “personalized” advertising. We refer to it here as “targeted” advertising. (It is also referred to as “cross-context” advertising under California law.) (This “opt out” right is required in some states, but we endeavor to extend this right to all consumers.)

We do not directly control the sending or initiation of targeted advertising, which is generally performed with cookies and similar technologies operated by vendors or third parties. However, we do sometimes provide personal information that is used in association with cookies and similar technologies for cross-context advertising. See the Third-Party Ad Networks section directly below for more information. 10. THIRD-PARTY AD NETWORKS AND YOUR PRIVACY CHOICES

We may use third parties such as ad networks to display advertisements on, or to consumers who have visited, our Site, to assist us in targeted audiences or displaying advertisements on third party websites, and to evaluate the success of our advertising campaigns or better understand those who view or click on our ads. Third party ad networks and similar providers, advertisers, sponsors and/or traffic measurement services may use cookies, JavaScript, web beacons (including clear GIFs), and other technologies to measure the effectiveness of their ads and to personalize advertising content to you. These third party cookies and other technologies are governed by each third party’s specific privacy policy, not this one. We may provide these third-party advertisers with information about your usage of our Site and our Services, as well as aggregate or non-personally identifiable information about visitors to our Site and users of our Service. 11. YOUR CHOICES REGARDING EMAIL COMMUNICATION

You can stop receiving email communications from us by clicking on the “unsubscribe link” provided in the email communications.

You can request that we stop sending you postal mail along with email by sending a request to privacy@springswf.com or calling us at 800-221-6352.

In either case, we will retain your email address in order to be able to abide by your opt out choice. We make efforts to promptly process all unsubscribe requests. You may not opt out of service-related communications (e.g., purchase and billing confirmations and reminders, changes/updates to features of the Services, and technical and security notices). There may be instances where we may not be able to delete your data or where we retain a copy of your data, for example, where we may need it to comply with a legal obligation or to protect the rights of others. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

12. LINKS TO OTHER WEBSITES AND SERVICES

We are not responsible for the practices employed by websites or services linked to or from our Site, including the information or content contained in such websites or services, and this policy does not apply to them. Your browsing and interaction on any third-party website or service, including those that have a link on our Site, are subject to that third party's own rules and privacy policies. Please read the terms of such websites carefully and exercise care when providing your personally identifiable information.

Social Media Features: Our Site includes links to social media features, such as links to our Facebook page. These features may collect your IP address, which page you are visiting while using our Site, and any Facebook cookies on your device (including your Facebook ID). These services may set cookies to enable the feature to function properly. Please note that the social media services may collect this information even if you are not logged in to the relevant social media account when you are using our Site. Your interactions with these features are governed by the privacy policy of the company providing it.

13. CHILDREN’S PRIVACY

Our online Services are not intended for children, and Springs provides no products or Service geared towards children. Our Site does not knowingly solicit or collect personal information online from children under age 18.

14. SECURITY AND DATA INTEGRITY

Springs uses various electronic, physical, technical, and procedural safeguards to protect and limit access to the information you provided to us via this online Service. Unfortunately, no data transmission or storage system is 100 percent secure; you therefore should not rely on our (or any) security protocols to be foolproof. Additionally, please note that information you send to us electronically may not be secure when it is transmitted to us because we do not control the security of your delivery channel.

15. NEVADA RESIDENTS

Certain Nevada consumers may opt out of the sale of “covered information” for monetary consideration to a person for that person to license or sell such information. “Covered information” includes first and last name, address, email address, phone number, Social Security Number, or an identifier that allows a specific person to be contacted either physically or online. 16. CHANGES TO PRIVACY POLICY

We reserve the right, at any time and without notice, to add to, change, update or modify this Privacy Policy, simply by posting such change, update or modification on the Site. Any such change, update or modification will be effective immediately upon posting on the Site. The date the Privacy Policy was last revised is identified at the top of the page.
