SPRINGS ADDENDUM FOR CALIFORNIA RESIDENTS CALIFORNIA PRIVACY RIGHTS

Spring Window Fashions LLC and its subsidiaries and affiliates ("Springs," "we," "us" or "our") provide this notice (the "CCPA Privacy Notice") to supplement the information contained in the Springs Privacy Policy. This CCPA Privacy Notice sets forth our privacy practices as required by the California Consumer Privacy Act of 2018 and related regulations ("CCPA").
The CCPA Privacy Notice applies only to individuals residing in the State of California who are considered "Consumers" under the CCPA and from whom we collect "Personal Information" as described in the CCPA ("California Consumers"). If you are not a California Consumer (or a resident of California), this does not apply to you and you should not rely on it. If you are a Bali Blinds employee, employee applicant, or contractor, please refer to the Bali Blinds Privacy Notice for California Consumer (Employees) which is the privacy policy that applies to you.
In the below tables and sections, we describe (as required by the CCPA):
- Our Collection of Personal Information – the types of Personal Information (which the CCPA defines broadly) that we collect, the types of sources we collect it from.
- Our Sharing or Sale of Personal Information – the types of recipients to whom we share or sell Personal Information.
- Our Business Purposes – our business purposes for (a) collecting and (b) sharing Personal Information, which are generally the same.
- Your California Privacy Rights and Choices – what rights you have under the CCPA, for instance, to request that we “opt out” your information from our marketing database (also called “do not sell” rights), or to request categories and personal information that we may have collected about you.
The following sets forth the categories of information we collect and purposes for which we may use California Consumers’ personal information:
Information We CollectWe may collect Personal Information from you in a variety of different situations, including, but not limited to on our website, your mobile device, through email, in physical locations, through the mail, and/or over the telephone. We also sometimes receive Personal Information from third parties, such as data compilers.
More specifically, Springs collects the following categories of Personal Information from and about its California Consumers, which will depend on the particular Business Purpose for which we collect it:

Personal Information does not include deidentified or aggregated consumer information.
Springs obtains the categories of Personal Information listed above from the following categories of sources:
- Directly from you. For example, from forms you complete or products and Services you purchase.
- Indirectly from you. For example, from observing your actions on our website or from information your computer or mobile device transmits when interacting with our website or mobile applications, among other things.
- Third parties such as dealers, window treatment specialists, and design consultants with whom you place product orders.
- Other third parties, which may include data compilers, business partners and co-promoters of our products (such as retailers, distributors, or online marketplaces).
Additional information on how we may use or disclose the Personal Information we collect from you or about you to do one or more of the following:
- To fulfill or meet the purpose for which you provided the information. For example, if you share your name and contact information to ask us a question or inquire about our products or Services, we will use that Personal Information to respond to your inquiry. If you provide your Personal Information to purchase a product or Service, we will use that information to process your order and payment.
- To contact you and to inform you about products, Services, promotions, special offers, and/or events that may interest you.
- To inform you about products and Services you have purchased from us, including to provide you warranty information.
- To provide, support, personalize, and develop our website, products, and Services.
- To create, maintain, customize, and secure your account with us.
- To process your requests, purchases, transactions, and payments and prevent transactional fraud.
- To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.
- To manage the health and safety of the workplace and our customers and/or to respond to or manage public health issues.
- If you provide your information in the context of an employment application or your employment, we will use your information to serve those purposes. Please review the Springs Privacy Notice for California Consumer (Employees) for more information.
- To personalize your Site experience and to deliver content and product and service offerings relevant to your interests, including targeted offers and ads through our website, mobile applications, third-party sites, and via email or text message (with your consent, where required by law).
- To help maintain the safety, security, and integrity of our Site, products and Services, databases and other technology assets, and business.
- For research, analysis, and business development, including to develop and improve our Website, products, and Services.
- To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
- As described to you when collecting your personal information or as otherwise set forth in the CCPA or subsequently agreed to by you.
- To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Springs assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Springs about our California Consumers is among the assets transferred.
Springs may share or disclose your Personal Information to a third party for a business purpose, including to our service providers.
We disclose, sell or share your personal information with the following categories of third parties:
- Service providers.
- Third parties with whom you direct us to share your personal information
- We may disclose your personal information to third parties for purposes of analytics and advertising. We provide information to analytics providers to better understand how consumers use the Services so we can improve the Services and create new products and services. We may also provide Personal Information to third-party advertising providers for targeted advertising purposes, so we can provide you with more relevant and tailored ads regarding our Services. Under the CCPA, disclosing personal information to these third parties may be considered a “sale” of personal information or the “sharing” of personal information for purposes of “cross-context behavioral advertising.”
In the preceding twelve (12) months, Springs has disclosed the following categories of personal information for a business purpose:
- Identifiers.
- Commercial information.
- Professional or employment-related information
- Internet or other similar network activity.
- Geolocation data.
Without being discriminated against for exercising these rights, the CCPA provides California Consumers with specific rights regarding their Personal Information. You also have the right to designate an agent to exercise these rights on your behalf. This section describes your CCPA rights and explains how to exercise those rights. To the extent permitted by applicable law, we may charge a reasonable fee to comply with your request.
Right to Opt-out of the sale of your personal informationCalifornia residents (and residents of any state) may opt out of the “sale” of their personal information. California law broadly defines what constitutes a “sale” – including in the definition making available a wide variety of information in exchange for “valuable consideration.” Depending what information we have about you, and whether we have included any of it in our marketing products and Services, we may have sold (as defined by California law) certain categories of information about you in the last 12 months, as described in the above.
Right to correct your personal informationCalifornia residents have the right to request that we correct inaccuracies about your Personal Information that we collect, use, or sell. As set forth below, you may also request the correction of specific pieces of personal information that we have collected from you. However, we may withhold the correction of some Personal Information where the risk to you or our business is too great to correct the Personal Information.
Access to specific Information and Data Portability RightsYou have the right to request that Springs disclose certain information to you about our collection and use of your Personal Information over the past 12 months. Once we receive and confirm your verifiable consumer request (see Exercising Your Rights), we will disclose to you:
- The categories of Personal Information we collected about you.
- The categories of sources for the Personal Information we collected about you.
- Our business or commercial purpose for collecting that Personal Information.
- The categories of third parties with whom we share that Personal Information.
- The specific pieces of Personal Information we collected about you.
- If we disclosed your Personal Information for a business purpose, a list disclosing our disclosures for a business purpose that identifies the Personal Information categories that each category of recipient obtained.
You have the right to request that Springs delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Your Rights), we will delete (and direct our service providers to delete your Personal Information from our records, unless an exception applies.
In accordance with the CCPA, we may deny your deletion request under certain circumstances, and will inform you of the basis for the denial, which may include, but is not limited to, if retaining the information is necessary for us or our service provider(s) to:
- Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
- Comply with a legal obligation.
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
- We do not knowingly collect Personal Information from minors under 16 years of age in California unless we have received legal consent to do so. If we learn that Personal Information from such California residents has been collected, we will take reasonable steps to remove their information from our database (or to obtain legally required consent).
To exercise your rights described above, please submit a verifiable consumer request to us by either:

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf (see below), may make a verifiable consumer request related to your Personal Information.
You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.
Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to Personal Information associated with that specific account.
We will only use Personal Information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.
In addition, you may “opt out” by going to the "Do Not Sell or Share My Personal Information" link in the footer of this website, and indicating that you do not want your information to be “shared,” which will suppress your personal information (such as cookie IDs on your browser) from being used for “cross context” or online interest-based advertising.
Authorized AgentsYou may designate an agent to make requests to exercise your rights under CCPA as described above. As appropriate, we will take steps both to verify the identity of the person seeking to exercise their rights as listed above, and to verify that your agent has been authorized to make a request on your behalf through providing us with a signed written authorization or (if required by law) a copy of a power of attorney.
Response Timing and FormatWe endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to an additional 45 days), we will inform you of the reason and extension period in writing.
We will deliver our written response by mail or electronically, at your option.
Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable.
If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Retention of Personal InformationWe will keep Personal Information for as long as it is necessary to fulfill the purposes described above, unless a longer retention is required or permitted by law. For purposes of our Services, we retain Personal Information so long as it is potentially useful to effectuate features, functions, intelligence, inferences or analysis within our database – for instance, to establish whether an email address is current or no longer in use, or whether other information is outdated or incorrect. We will delete or de-identify your information sooner if we receive a verifiable deletion request, subject to exemptions under applicable law.
Opt Out SignalYour browser may also offer a Global Privacy Control signal (“GPC”). Our Sites each treat a GPC-enabled browser as having elected to exercise the opt-out choices described immediately above with respect to “sales” and “sharing” for targeted advertising purposes that occur through the use of cookies and similar technology on that browser. You can override that treatment for a GPC-enabled browser by using the cookie controls available from the Site’s footer.
Incentive ProgramsThe Services may offer opportunities to receive certain services or benefits such as discounts or free or extended services (such as bonus streaming time or additional videos), which may require the provision of personal information. Such opportunities could be considered a financial incentive under applicable law (each, an “Incentive Program”). When you participate in an Incentive Program, you agree to the terms of that Incentive Program, and may revoke your participation depending on the Incentive Program (e.g., by opting out of emails or terminating a streaming service). To the extent we can determine the value of your information, we consider the value to you (and costs to us) of providing you with a discount, as compared to the value to us in an opportunity to gain a loyal, or even more loyal, customer; we seek to reasonably relate the benefits to you to the costs to us.
Changes to Our CCPA Privacy NoticeSprings reserves the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will post the updated notice on the Site and update the “Last Updated" date above.
California “Shine the Light” disclosure.The California “Shine the Light” law gives residents of California the right under certain circumstances to opt out of the disclosure of certain categories of personal information (as defined in the Shine the Light law) with third parties for their direct marketing purposes, or in the alternative, that we provide a cost-free means for consumers to opt out of any such disclosure. To the extent we ever share information for the above purpose, you may opt out of such sharing by sending an email to privacy@springswf.com and referencing a “Shine the Light” or “opt out” request.
